依據司法院院解字第3806號「來電所述既非對於特定人或可推知之人所發之言論自不構成刑法第三百零九條及第三百一十條之罪」之意旨,只要內容涉及公然辱罵並讓對方感覺受辱,即便沒有指名道姓,只要足以讓不特定的多數人能夠辨識出是在罵誰,即構成公然侮辱罪。所以網友們在網路上的發言應該要保持理性,以免不甚觸法喔!
