遇到警察臨檢時,可以拒絕酒測嗎? Can you refuse a breathalyzer test during a police check?

酒後駕車造成的交通事故頻傳,為了嚇阻酒駕,近年來已多次修正刑法第185 條之3的「醉態駕駛罪」,期以加重酒駕刑責遏止之。

由於酒駕除有三年以下有期徒刑的刑責(請參刑法第185條之3之規定)外,還可被課處「十八萬元罰鍰、吊銷駕照」(請參《道路交通管理處罰條例》第35 條第4項的規定)。因此,以往常有駕駛人遇到臨檢時,選擇拒絕酒測,以行政 處罰的代價換取對刑責風險的規避。然而,這樣的作法現在已經行不通了!

因為,依據《道路交通管理處罰條例》第35條第6項規定,警方依法可將「肇 事」駕駛人強制送醫療檢驗機構進行驗血:即便沒有肇事,依《取締酒駕拒測 處理程序》若駕駛人有《刑法》第185條之3規定「客觀情狀足認不能安全駕 駛」時(例如:車行不穩、蛇行、語無倫次、口齒不清等),可依《刑事訴訟 法》第88條「現行犯」之規定逮捕駕駛人,再依《刑事訴訟法》第205條之2 規定,強制進行吐氣檢測:若駕駛人拒絕接受吐氣測驗,警方將依《刑事訴訟 法》第205條之1規定,陳報檢察官核發「強制抽血檢測」的鑑定許可書。若 「檢察官許可,則可強制驗血。

所以,依目前的實務,拒絕酒測不但要吃上十八萬罰鍰、吊銷駕照,還可能被 強制驗血,請不要以身試法喔!

Drunk driving has led to numerous traffic accidents. To deter this behavior, the law has been amended multiple times in recent years, increasing penalties under Article 185-3 of the Criminal Code, which punishes drunk driving offenses more severely.

Due to the penalties for drunk driving, which include up to three years of imprisonment (refer to Article 185-3 of the Criminal Code), as well as a fine of up to 180,000 NTD and revocation of the driver's license (refer to Article 35, Paragraph 4 of the Road Traffic Management and Penalty Act), many drivers used to refuse breathalyzer tests during police checks, opting to face administrative penalties rather than the criminal risks. However, this approach is no longer effective!

Under Article 35, Paragraph 6 of the Road Traffic Management and Penalty Act, the police are authorized to force drivers involved in accidents to undergo medical blood tests. Even if there is no accident, according to the "Procedures for Handling Refusal of Alcohol Testing", if a driver exhibits "objective signs of unsafe driving" as outlined in Article 185-3 of the Criminal Code (such as unstable driving, swerving, slurred speech, unclear articulation, etc.) the police may arrest the driver as a "flagrante delicto" under Article 88 of the Code of Criminal Procedure. Following this, the police may proceed with a breath test under Article 205-2 of the Code of Criminal Procedure. If the driver refuses the breath test, the police will report to prosecutor, who may then issue a court order for compulsory blood testing under Article 205-1 of the Code of Criminal Procedure. If authorized by the prosecutor, the blood test can be carried out forcibly.

Therefore, under current practice, refusing a breathalyzer test not only results in a fine of 180,000 NTD and revocation of your driver's license, but you may also be subjected to forced blood testing. It's strongly advised not to test the law.
