民眾對於電力公司無預警停電所受之損害，可否請求國家賠償?
坊間常認為: 台電乃「國營」事業，其因台電無預警停電所受之損害 (例如: 冷凍庫的貨物因停電而腐壞)，應由國家負擔損害賠償責任。 實則，台電雖為國營事業，但具有獨立之法人格。因此，台電之違失，仍應由台電自行擔負，而與國家賠償無關。
此外，由於《台灣電力公司營業規則》第三十八條規定 (即: 如有下列情形之一者，台電得為「停止供電」或「限制用電」) 對於台電之停電所致之損失，尚難予以求償:
1. 依法令規定；
2. 遭受天災或其他不可抗力之事故；
3. 設備故障或運轉方生事故；
4. 電源供應不足；
5. 檢修設備、工程施工或其他供電安全上之需要時。
但是，由於同法條規定台電於「停止供電」前，除事先無法預知之事故者外，應『預先』公告、新聞媒體發布或其他方式通知。據此，台電於停電前，仍應「事先」通告週知，使民眾得已預先準備以減少損失。否則，台電之停電如「不符合法令要件」或「未事先通知」致民眾受損時，民眾仍可依其他法律規定，向台電請求賠償。
Many people believe that since Taipower is a "state-owned" enterprise, any loss caused by an unexpected power outase such as food spoiling a freezer-should ben compensated bx the government. However, although Taipower is state-owned, it is a legally independent entity (a legal person). This means that if Taipower is at fault, it must take responsibility itself. Such situation are not covered under the State Compensation Law, and the government is not liable for Taipower's mistakes.
In addition, under Article 38 of the Taiwan Power Company Business Rules, Taipower may suspend or limit power supply in the following situations. Therefore, losses resulting form such power outages are generally not compensable:
When required by law or regulations;
1. In the event of natural disasters or other force major incidents;
2. Due to equipment malfunction or operational accidents;
3. When there is insufficient power supply;
4. When maintenance, construction, or safety of power supply requires it.
However, the same article also states that unless the outage is caused by an unforeseen emergency, Taipower must provide advance public notice - either through announcements media reportsor other communication methods - before cutting power. This means that Taipower is still obligated to notify the public in advance to allow people time to prepare and reduce losses. If the power outage does not meet legal requirements or occurs without proper notice, and causes damage to the public, individuals may still seek compensation from Taipower under other legal provisions.
